Employee/Personnel Relocation to Czech Republic

Employee/Personnel Relocation to Czech Republic

Employee/personnel relocation to Czech Republic is possible through several immigration programs. One of the options foreign employees have is the intra-company transfer (ICT).

This program is addressed solely to persons who immigrate to Czech Republic as the employees of a company that has set up an office in this country (typically, in a parent – subsidiary/branch type of relationship).

Our immigration lawyer in Czech Republic can help you apply for this program and you can also receive assistance on any other programs that involve employee relocation.

Who can apply for the ICT in Czech Republic?

The ICT program is available at an EU level and it is designed as an immigration program for persons outside the European Union (EU), European Economic Area (EEA) and Switzerland, according to the Ministry of Foreign Affairs of the Czech Republic.

In the list below, our immigration lawyer in Czech Republic has highlighted some of the characteristics of the ICT program:

  • the document can be obtained when the duration of stay in Czech Republic is of at least 3 months;
  • depending on the category the foreign employee falls into, the ICT can have a validity of 1 year or 3 years;
  • foreign nationals that fall under the list presented by the Section 42k(6) of Act No. 326/1999 Coll. can’t participate in this program;
  • employee/personnel relocation to Czech Republic is possible only for foreign employees who have been working for minimum 6 months in the foreign company;
  • a decision on the issuance of the ICT can be made in 90 approximately days;
  • please mind that the documentation for employee/personnel relocation to Czech Republic must not be older than 180 days (the signed/stamped/translated versions).

What conditions must the employee comply to?

Besides the matters presented above, the law on immigration in Czech Republic regulates the types of employees who can qualify (rules can slightly vary from one EU country to another), the education level, the area of expertise, etc.

Therefore, one must know that employee/personnel relocation to Czech Republic is possible for those work in the foreign company as one of the following:

  1. manager;
  2. specialist;
  3. intern.

A person can’t participate in the program if he or she has already applied for a different type of permit (long-term residence permit) that will be issued for research in Czech Republic.

It is also mandatory that the foreign applicant has completed higher education and has specialized knowledge in his or her field of activity.

What documents must be prepared for the Czech ICT?

When a person applies for immigration to Czech Republic, it is always necessary to prepare a set of supporting documents. One has to prepare documents for visa application, for residence permit issuance and the documentation varies from one visa type to another.

For employee/personnel relocation to Czech Republic, one will need to prepare many documents attesting the employment in the foreign company. Some of the basics documents which are necessary for most visas, are:

  1. the passport and other personal identification documents;
  2. the completed application form;
  3. 2 recent photos;
  4. fingerprints.

This is the 1st category of documents. The next one, which is mandatory for those who will move to Czech Republic, refers to the documents attesting the purpose of stay.

In this case, the purpose of stay is employee/personnel relocation to Czech Republic and the applicant must submit information about the current position he or she has in the foreign company, details on the employment contract (number of working hours, salary, etc.).

Given that the list of documents is rather extensive, we invite you to contact our immigration lawyer in Czech Republic for finding out any other relevant information that can be useful when applying for the ICT.
